1. Acceptance of Terms
By accessing or using Intonation Lab ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.
2. Description of Service
Intonation Lab is a browser-based ear training tool that provides real-time pitch analysis and feedback for singers practicing just intonation. The App uses your device's microphone to detect pitch and provides visual and auditory feedback through your web browser.
3. Access and Accounts
Access Codes
Access to the App requires a valid access code and associated email address. Access codes may be:
- Single-use — Valid for one individual across multiple devices.
- Multi-use — Valid for multiple individuals, such as members of a chorus or ensemble.
Your access code is personal to you (or your group, for multi-use codes). You may not sell, transfer, or redistribute access codes unless you are the original purchaser distributing multi-use codes to your intended group.
Multi-Device Access
You may use the same access code and email combination across multiple devices.
4. Purchases and Payments
Payment Processing
All payments are processed securely through Stripe. By making a purchase, you also agree to Stripe's Terms of Service.
Delivery
Access codes are delivered automatically to your provided email address upon successful payment. If you do not receive your access codes, please contact us.
Refunds
If you experience technical issues that prevent you from using the App and we are unable to resolve them, you may request a refund by contacting us within 14 days of purchase. Refund requests are evaluated on a case-by-case basis.
5. Acceptable Use
You agree not to:
- Attempt to circumvent the access code system or gain unauthorized access to the App.
- Reverse engineer, decompile, or disassemble any part of the App.
- Use the App for any unlawful purpose.
- Redistribute, resell, or sublicense access to the App except as permitted for multi-use codes.
- Interfere with or disrupt the App's functionality or its supporting infrastructure.
6. Microphone and Browser Permissions
The App requires microphone access to function. You grant this permission through your browser, and you may revoke it at any time through your browser settings. The App does not function without microphone access, but no audio is recorded or transmitted. See our Privacy Policy for details.
7. Intellectual Property
All content, design, code, visualizations, documentation, and training curriculum within Intonation Lab are the intellectual property of Intonation Lab and its creator(s). You may not copy, reproduce, distribute, or create derivative works from any part of the App without prior written permission.
8. Local Data and Progress
Your settings and training progress are stored locally in your browser's storage. You are responsible for understanding that:
- Clearing your browser data will erase your saved progress.
- Progress is tied to a specific browser on a specific device and does not sync across browsers or devices.
- We are not responsible for lost progress due to browser data clearing, device changes, or browser updates.
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Fitness for a particular purpose — The App is an educational tool designed to help develop intonation skills. It is not a substitute for professional vocal instruction, music education, or hearing assessment.
- Accuracy — While the App uses established acoustic principles and algorithms for pitch detection, results may vary depending on your microphone quality, ambient noise, browser, device, and singing technique. The App should not be used as a precise measurement instrument.
- Availability — We do not guarantee uninterrupted or error-free access to the App.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Intonation Lab and its creator(s) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, progress, or access arising out of or related to your use of the App.
Our total liability for any claim arising from your use of the App shall not exceed the amount you paid for access.
11. Health and Safety Notice
- Hearing safety — When using headphones with the App, keep the volume at a comfortable level. Extended listening at high volumes can damage your hearing.
- Vocal health — The App is a training aid, not a vocal coach. If you experience vocal strain, discomfort, or pain while singing, stop and consult a qualified vocal instructor or medical professional.
12. Modifications to the App and Terms
We reserve the right to modify, update, or discontinue the App or any of its features at any time without prior notice.
We may update these Terms of Use from time to time. Changes will be reflected by updating the "Last updated" date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated terms.
13. Termination
We reserve the right to revoke access to the App at our discretion if these terms are violated.
14. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles.
